Basic policy on the protection of personal information

Intermestic Inc.

Intermestic Inc. and its group companies (the “Group” hereafter) own many pieces of personal information and data in order to conduct their business and consider the protection of personal information as their grave responsibility. In order to gain and maintain trust widely from people who provide personal information as well as from society in general, the Group hereby establishes its basic policy on the protection of personal information and pledges to protect such personal information.

The Group will make all the people engaged in its business activities thoroughly aware of the importance of personal information in accordance with related laws and regulations as well as the rules and stipulations of the Group and deal with such personal information appropriately.

1. Appropriate collection, utilization, provision and commission of personal information

(1) In gathering personal information, the Group will gather only such information as it considers necessary after clearly specifying the purpose of utilization and informing or announcing the purpose of utilization, thereby utilizing the information within the scope as specified. Personal information will be utilized for the following purposes.
  • 1. To respond to a variety of inquiries about service after sales of eyeglasses and related products.
  • 2. To provide new information (new stores, new products, etc.) about eyeglasses and other related businesses.
  • 3. To provide information or contact individuals on proposals, services, events and questionnaires by the Group.
  • 4. To select prospective employees in the Group’s hiring activities and to manage hiring and selection activities, to provide hiring and other information, to draft various statistics, materials and other means of communication, to process contracts of employment between applicants hired for work and the Group, or otherwise to conduct hiring activities appropriately and smoothly.
  • 5. To respond to the important needs for contacting individuals for purposes other than those specified above, when such needs arise.

Further, when difficulties occur in contacting individuals or in sending invitations because of changes in retained personal information, such as the names of municipalities or postal numbers, the Group may change the information registered with the group as necessary.

(2) The personal information that has been collected will not be made available to a third party except in the following cases.
  • 1. In cases in which prior consent is obtained from the provider of information.
  • 2. In cases in which personal information is collected in accordance with Paragraph 2 (opt out) or 3 (joint utilization) of Article 23 of the Act on the Protection of Personal Information.
  • 3. In cases in which personal information is provided or disclosed in accordance with laws and regulations.
  • 4. In cases in which personal information is disclosed, as necessary, for the purpose of conducting the Group’s hiring activities smoothly by entrusting the handling of such information to a business or an individual.
(3) When personal information is utilized by entrusting such information to a third party, the appropriateness of such a measure will be examined in consideration of the safety management and other measures and conditions at the third party and appropriate supervision of the third party will be rendered by taking such measures as providing the information only after concluding a non-disclosure agreement.

2. Security measures concerning personal information

Rules and regulations will be established or improved and security measures will be taken within the Group in order to prevent or rectify unauthorized access to personal information and the leakage and loss of, and damage to such information.

3. Remedial measures

The Group will try to respond accurately to changes in the social environment regarding the handling of personal information. The Group will also attempt to make improvements, as necessary, by changing or amending this policy and other rules and regulations or making additions to them.

4. Responding to requests for disclosure, corrections

When there is reason to believe that the Group is not honoring its policy on the protection of personal information, or if individuals desire to disclose, correct, add, delete or discontinue the utilization of personal information, please contact the following office. The Group will respond within the scope of a reasonable period of time and appropriateness.

Disclosure matters based on the “Act on the Protection of Personal Information”

1. Matters concerning disclosure of the purpose of utilization of personal information

The purpose of utilization when information is acquired directly or indirectly in a contract or in a document (Paragraph 2, Article 18)
When acquiring personal information in a document directly from a customer, the Group will expressly show the purpose of utilization each time. (Paragraph 2, Article 18) When acquiring personal information directly by other means, or acquiring such information indirectly, the Group will utilize the information within the scope of the following purposes of utilization.

2. Providing personal information to a third party (Paragraph 2 and 3, Article 23)

The Group will appropriately manage personal information it acquires from its customers and will under no circumstance provide such information to a third party without prior consent of the customer except in the following cases.
  • 1. In cases in which information is acquired in accordance with laws and regulations.
  • 2. In cases in which the provision of personal information is necessary for the protection of the life and body of an individual and in which it is difficult to obtain the consent of the person.
  • 3. In cases in which the provision of personal information is necessary for improving public health and promote the sound growth of children and when it is difficult to obtain the consent of the person.
  • 4. In cases in which the provision of personal information is necessary for cooperating with a state organization, a local government or an individual entrusted in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person is likely to impede the execution of the affairs.

3. Procedures to meet requests for disclosure and others (Article 29)

(1) Items subject to requests for disclosure (“information concerning the identification of retained personal data”). The following are items of “retained personal data” that are subject to requests for disclosure.

  • 6. Date of Purchase

  • 9. Information on frames sold
  • 10. Information on lenses sold
  • 11. Prescription information

  • 13. Various information submitted by applicants in the hiring activities of the group.

The disclosure information is as of the time of the last purchase of a product of the Group by a customer.

(2) Where to file requests for disclosure
Individuals are requested to file requests for disclosure of information using the specified application form and to send it, together with necessary papers, to the following office by mail, fax, or e-mail or to bring it to individual stores.

(3) Documents (forms) to be submitted in requesting information disclosure, others
In filing a request for disclosure, please obtain the following application form(A) either by ①downloading it from the Group’s website, ②visiting a Group store, ③ requesting to mail it by telephone. Please fill in all the specified items and also submit a document or documents (B) for your personal identification to the above addresses (2).
  • (B) Documents for personal identification (all before expiration dates). Please choose two from among the following.

  • ・Passport
  • ・Basic Resident Register Card (with a photo)
  • ・Certificate of Alien Registration
  • ・Certificate of Residence
  • ・Certificate of Health Insurance
  • ・Certificate of Employment
(4) Filing requests “for disclosure and others” through an representative
If the person requesting disclosure is that said person himself or herself, or a minor or a legal representative of the guardian of an adult or a representative entrusted by the person who is seeking disclosure, please submit the following documents.
  • ・Copy of family register
  • ・Adult Guardianship Registration Certificate
  • ・Letter of attorney (a certificate of the registered seal is necessary)
(5) Charges for requesting disclosure and collection method
400 yen per request
Please submit postage stamps worth 400 yen or a money order in that amount together with application papers.

*Individuals will be notified if the charge is inadequate or if it is not paid. If there is no payment within the set period of time, however, the Group will consider it as equal to the absence of a request for disclosure.

(6) Method of meeting requests “for disclosure, etc.”
A response will be provided in writing to the address specified in the application form filed by the applicant.
(7) The “purpose of utilization” of personal information acquired concerning requests for disclosure, etc.
The personal information acquired in response to a request for disclosure and others will be processed only within the scope necessary for meeting the request for such information. The documents that have been submitted will be preserved for two years after the response to a request for disclosure is completed and will thereafter be destroyed.
However, information will not be disclosed in the following cases. In such cases, the person who filed the request will be notified accordingly with a reason or reasons for the action. The specified charge shall still be paid in such non-disclosure cases.
  • ・In cases in which the address written in the application form, in the document or documents for the identification of the person and the one registered with the Group do not match, or the person otherwise cannot be identified
  • ・In cases in which the rights of representation cannot be confirmed in a request made through a representative
  • ・In cases in which there are deficiencies in the specified application documents
  • ・In cases in which there is fear of damage to the life, body, assets and other rights and profits of the person filing the request or of a thirty party
  • ・In cases in which there is fear of serious impediments to the appropriate implementation of business of the Group
  • ・In cases in which requests violate other laws and regulations

4. Items concerning the office for accepting “complaints” (Article 24, Paragraph 1, Item 4 of the Act on the Protection of Personal Information, Article 5 of the Order for Enforcement of the Act on the Protection of Personal Information, Article 31 of the Act on the Protection of Personal Information)
